What exactly is a Lasting Power of Attorney?

A Lasting Power of Attorney (LPA) is an extremely powerful document. It enables us to appoint someone to deal with our affairs if we are mentally or physically unable to do so for ourselves. Many business people prepare an LPA if they have to travel frequently so that someone can act for them if they are overseas. Lots of older clients prepare an LPA ‘just in case’ they should lose their mental capacity at some point. It provides peace of mind to ensure that someone of our clients’ own choosing can make decisions on their behalf, should they not be able themselves, for whatever reason.

It is possible to prepare an LPA regarding health or financial decisions. Often decisions in both areas are critical to our contentment and well-being, particularly as we get older. Clients often find themselves considering an LPA when they hear of (or even experience first-hand) the problems that can ensue if someone loses mental capacity and doesn’t have an LPA in place. The scenario can be extremely challenging and stressful. Considering if you or your loved ones need an LPA is all part of doing a ‘health check’ of your own personal affairs. It is, just like a Will, another thing on the ‘to do’ list and of course something that doesn’t bear thinking about. No one wants to deal with the idea of losing mental capacity.
